2. Make a contract with us

2.1 When you place an order with us, you are making an offer to buy artwork. We will send you an e-mail to confirm that we have received your order.

2.2 In the unlikely event that the artworks are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an e-mail confirming acceptance of your order, and there will be no contract between us.

2.3 Images of artworks on this website are for illustrative purposes only. Your artwork may vary slightly from the image shown on the website and will not include any of the pictured accessories unless stated in the specification of the artworks. Whilst artworks may be shown assembled they may require assembly by you.

2.4 We have made every effort to display as accurately as possible the colours of our artworks that appear on this website. However, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the actual artwork.

2.5 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.

2.6 This contract is covered by English law.

2.7 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

3. How to place order

3.1 You can use our website to place an order by selecting the artwork you wish to buy in our online store and adding it to your basket. Items you do not require can be removed from your basket at any time. If you prefer to order by telephone you can do so by calling +44(0)7958765291, or contact us by email on info@woldtgallery.com. Artworks which are not available in the online store have to be ordered by phone +44(0)7958765291 or Email: info@woldtgallery.com

3.2 If purchasing a quote, the buyer accepts full responsibility for checking the accuracy of that quote.

3.3 Carriage charges will be shown prior to you placing your order. For orders, via phone or Email, we suggest to contact us regarding carriage costs and delivery times.


3.4 You will be required to pay for the artworks in full at the time of ordering or purchase in the online store. 

3.5 We use secure payment facilities for online purchases. You can pay for your order by PayPal or bank transfer (please contact us via phone +44(0)7958765291 or email on info@woldtgallery.com to provide bank account details). The artwork will be dispatched after the payment arrives on our bank account.

3.6 Promotional prices only apply during the period stated.

3.7 All prices quoted on our website are in UK pounds and include Value Added Tax at the current rate.

3.8 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.

3.9 Once your order is complete we will notify you of the dispatch date.

4. Delivery & Carriage Charges

4.1 Artworks will be dispatched from our store or the artist's studio within 10 working days and an estimated dispatch date is an estimate, which can change without notice. Dispatch may be delayed in accordance with point 4.12.

4.2 We will deliver goods within 2-3 working days of dispatch. Deliveries may be delayed in accordance with point 4.12.

4.3 Your order may arrive in more than one delivery.

4.4 We can deliver our artworks to mainland Great Britain and the Republic of Ireland. We are able to deliver in other countries oversee, however, this is subject of different dispatch times and charges (please contact us via telephone to clear and agree on the cost and time of delivery, if needed).

4.5 We will deliver the artworks to the premises you specify on your order.

4.6 Some of our artworks are relatively weighty and more valuable than others, in such a case we suggest to accept the order in person. If there is no one to accept the order on the scheduled delivery date the artworks may be returned to our store or artist's studio and we reserve the right to charge you an additional re-delivery charge.

4.7 Disposal of packing materials is your responsibility.

4.8 If you change the delivery address once the artworks have been dispatched to you, we reserve the right to pass on any extra charges made by the carriers for redirecting your delivery, if the carriers are able to make the change. This will delay your delivery.

4.9 Please check the artworks on delivery - any artwork found to be missing or damaged should be notified to the delivery driver at the time of delivery or ourselves within two working days of delivery of the items.


4.10 If the artworks are lost or damaged please report this to us within two working days from the delivery day (to us either via Email to info@woldtgallery.com or telephone +44(0)7958765291.

4.11 Deliveries, which are agreed to be received in person are made to a ground floor entrance only and on the condition that there is reasonable access for the safe and prompt delivery of the artwork.

4.12 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of God, war, riot, civil commotion, malicious damage or the default of our suppliers. We are not responsible where this causes a delay or failure in delivering your artworks.

4.13 Time is not the essence of the contract unless expressly stated otherwise in writing by the Director of the Company.

5. Cancellation and returns

5.1 You can cancel your contract at any time up to 14 days after the day of delivery. To do this, please e-mail or write to us. We are unable to accept cancellations by phone.

5.2 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.

5.3 If you cancel, you must return the artworks within 14 days of cancellation, complete with the original packaging to us and/or the artist (or any other UK address specified by us), at your own expense. You must ensure that the artworks are packaged adequately to protect against damage.

5.4 You may properly examine the goods for 14 days as you would do had you visited our gallery, however you may not return any artworks that have been installed unless they are faulty.

5.5 If you fail to return the artworks, we will collect only those which have been received in person (refer to point 4.6), and we will charge you the direct cost of collection. If you fail to take reasonable care of the artworks before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value. For prints and photographs and smaller items up to purchase price of 500,00 Pounds, we will charge you for loss an amount of purchase price, if you fail to return the artworks to us.

5.6 We will refund all monies paid to us by you including any postage/carriage within 30 days, less any costs due under this contract. 

5.7 We reserve the right not to replace any item that has been fitted, as we will deem this acceptance of the artworks.

5.8 We will not be held liable for fitters fees or any other professional tradespersons fees due to late, damaged or lost deliveries.

5.9 We are not liable for any lost earnings due to late, incorrect or lost deliveries.

5.10 We reserve the right to refuse replacements on any damaged items reported to us outside of two working days. Please refer to points: 4.9 and 4.10.

6. Faulty Artworks / Guarantee

6.1 If there is a problem with the artwork, please notify us by email or in writing providing details of the problem. In addition, you must provide us with a digital photograph of the issue as this saves you having to return the artwork for inspection. We will deal with the matter in accordance with your legal rights. Please see points 4.9 and 4.10 for time restrictions.

6.2 WOLDT GALLERY doesn't provide any guarantee for faulty goods, because we are not the manufacturer. In case of issues, the gallery refers to the artist as the producer. 

6.3 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement artworks will not be dispatched until either an indicative digital image is supplied by the customer, or the original artwork has been received at our store or the artist's studio and checked.
The cost of returning artworks to us is your responsibility, however, on inspection we will refund your reasonable postage costs, providing that the artworks are found to be faulty. If the artworks are not faulty, we will return them to you, however, you will be required to cover our reasonable postage costs.

6.4 Protec advice: Artworks should be reasonably cleaned in accordance with special advice by the manufacturer, the artist as producer, if provided, failure to do so may void your warranty. 

6.5 All our products, also part of editions, are unique, therefore we are not able to replace the product by the same. You can ask us to provide a comparable item regarding the authorship, size, and price (subject to availability).

6.7 Where we replace faulty artworks you are responsible for their disposal if they have not previously been returned to us.

6.8 We are unable to guarantee an exact colour match due to the nature of the product.

6.9 All artworks details available on the website are provided to the gallery by the manufacturer (the artist as producer) in case of variation regarding size we will transfer the requests to the artist for clarification. WOLDT GALLERY doesn't provide any guarantee for the details provided by the artist. 

7. Liability

7.1 We do not accept liability for any consequential loss of profit or indirect losses. You should therefore not book installation of the goods until you have received them and inspected them.

9. Ownership of the artwork copyright

9.1  The artist has provided the artwork to the WOLDT GALLERY for sale on the strict understanding that it will be available for purchase exclusively through the WOLDT GALLERY. It is the artist's expectation that the artwork will not be purchased for resale and will be retained by you for your own personal enjoyment. Specifically, you may not sell or offer for sale the artwork on any internet based auction or other websites.

9.2 Copyright in the artwork remains the property of the artist unless other stated. 

9.3. You may not produce any image of the artwork and may not, at any time, publish or submit for publication or reproduction any image of the artwork to any third party, including any internet website for any purpose. 

If you breach any of your obligations under paragraph 9.3 you agree that:

(a) the payment of damages will not be a sufficient remedy to compensate us or the artist for your breach;

(b) we may, and the artist may apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and

(c) we may, and the artist may, contact the operator of any internet website on which the artwork is being offered for sale or on which an image of the artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.

3. Site Uptime

3.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to the server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time.

4. Links to and From other websites

4.1 Any links to third party websites located on this Website are provided for your convenience only. We have not reviewed each third party website and have no responsibility for such third party websites or their content.

4.2 If you would like to link to this Website, you may only do so on the basis that you link to, but do not replicate, any page on this Website and you do not in any way imply that we are endorsing any services or products unless this has been specifically agreed with us.
